Hot 5: Tax appeal deadline, prison reform & more

  • Deadline nears for Alabama Tax Tribunal participation

    There will be a new process for appeals of all taxes (other than ad valorem) next month, and counties that do not use the Alabama Department of Revenue for their collections have until Oct. 1 to make an initial decision on whether to participate. Unless these counties officially opt out, appeals of their local levies, such as sales and use taxes, would be heard by the new Tax Tribunal. To opt out, the county commission must adopt a resolution to that effect, provide a copy of that resolution to the new agency and establish its own appeals process. This is not a one-time opportunity, since counties have the choice to change their participation in the tribunal once a year.     Fuel Storage Tank Trust Fund guidelines

    At the recent ACCA Convention, there was great interest among county engineers in the new requirements to receive money from the Alabama Underground and Aboveground Storage Tank Trust Fund. ADEM has released a new fact sheet specific to reimbursement guidelines for aboveground storage tanks.  (Please see this presentation for more info:  Storage Tank Trust Fund Reimbursement Guidelines )


    Prison Reform Policy Team had productive meeting with national experts

    ACCA was proud to welcome three representatives from the Council of State Governments to Montgomery last week so the consultants who are helping reform efforts at the state level could hear directly from county leaders about the local situation and potential impacts. The consultants assured the County Policy Team on Prison Reform that it was not their intent – or the intent of state leaders – to shift the prison overcrowding burden from the state to the counties. For their part, county leaders did an outstanding job of communicating county concerns with detail and insight. Many thanks to all who contributed to the meeting’s impact.


    Preparing for new commissioners

    Many county commission seats are on the ballot in November, which means changes are ahead. State law establishes when one term of office ends and the next one begins and sets the date of the first commission meeting after the election. To ensure a smooth transition, this memo provides a reminder about key dates for counties with commissioners on the ballot this year. (See also related code sections)


    Alabama Bar Association seeks county support

    Throughout October, the Alabama Bar Association is marking Pro Bono Month to recognize lawyers who provide legal services to low-income Alabamians on a volunteer basis and to encourage other lawyers to give their time. A proclamation from the governor is expected, and the bar association is also asking counties to issue proclamations this month.
